PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION, AND PHOTOGRAPHY CONSENT AGREEMENT

This Participant Waiver, Release of Liability, Assumption of Risk, Indemnification, and Photography Consent Agreement (“Agreement”) is entered into between the undersigned participant (“Participant,” “you,” or “I”) and PGH Craft Club, also doing business as Pittsburgh Craft Club (“PGH Craft Club,” “we,” “us,” or “our”), in connection with Participant’s registration for, purchase of a ticket to, and attendance at any event hosted or organized by PGH Craft Club, whether now scheduled or scheduled in the future (each, an “Event”).

By checking the “I agree” box at checkout, completing purchase of a ticket, and/or attending or participating in an Event, Participant acknowledges that they have read this entire Agreement, understand its terms, and voluntarily agree to be bound by it each time they register for or attend an Event. This Agreement is a legally binding contract. If Participant does not agree to these terms, Participant should not purchase a ticket or attend an Event.

1. Assumption of Risk

Participant understands that attending and participating in PGH Craft Club events, including hands-on craft-making activities, involves inherent risks of injury, illness, or property damage. These risks include, but are not limited to:

  • Use of sharp or pointed tools and materials, including scissors, craft knives, blades, needles, pins, and wire cutters
  • Use of hot or heat-generating tools and materials, including hot glue guns and irons
  • Exposure to adhesives, paints, dyes, solvents, and other chemicals or materials that may cause skin, eye, or respiratory irritation, or allergic reaction
  • Allergens present in shared materials, food, or beverages provided at or brought to the Event
  • Slip, trip, and fall hazards, and injuries arising from movement around a shared workspace, seating, or crowded areas
  • Conditions of the venue itself, including its premises, fixtures, furnishings, parking areas, and equipment not owned or controlled by PGH Craft Club
  • The acts, omissions, or negligence of other attendees, vendors, instructors, or third parties present at the Event
  • Illness, including communicable illness, that may result from attending an in-person gathering

Participant voluntarily assumes full responsibility for any and all risks of injury, illness, death, or property damage, whether known or unknown, arising out of or related to Participant’s attendance at or participation in the Event, however caused, including as a result of the negligence of PGH Craft Club or others.

2. Release and Waiver of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PARTICIPANT HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE PGH CRAFT CLUB, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AND VOLUNTEERS, AND THE VENUE(S) HOSTING THE EVENT AND THEIR OWNERS, OPERATORS, AND STAFF (COLLECTIVELY, THE “RELEASED PARTIES”), FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, INJURY, ILLNESS, OR DEATH THAT MAY BE SUSTAINED BY PARTICIPANT, OR ANY PROPERTY BELONGING TO PARTICIPANT, WHILE ATTENDING, TRAVELING TO OR FROM, OR PARTICIPATING IN THE EVENT, WHETHER ARISING FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY OR OTHERWISE.

This release does not apply to, and nothing in this Agreement waives, limits, or releases any claim arising from a Released Party’s gross negligence, recklessness, or intentional misconduct, or any right or protection that cannot be waived as a matter of Pennsylvania law.

3. Indemnification and Hold Harmless

Participant agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties - including PGH Craft Club / Pittsburgh Craft Club, its owners, officers, employees, instructors, contractors, volunteers, and affiliates, and the Event venue(s) and their owners and staff - from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) Participant’s attendance at or participation in the Event; (b) any injury to or property damage caused by Participant to any other person; or (c) Participant’s breach of this Agreement, except to the extent such claims arise from a Released Party’s gross negligence, recklessness, or intentional misconduct.

4. Medical Care Authorization

In the event Participant is injured or becomes ill during the Event, Participant authorizes PGH Craft Club representatives to secure emergency medical treatment on Participant’s behalf, including calling emergency services, and agrees that Participant is solely responsible for any costs associated with such treatment. PGH Craft Club is not responsible for evaluating Participant’s fitness to participate in Event activities.

5. Personal Property

PGH Craft Club and the Released Parties are not responsible for any loss, theft, or damage to personal property brought to or left at the Event, including materials, tools, or finished craft projects.

6. Photography and Video Consent

Participant understands that photographs and video may be taken during the Event by PGH Craft Club staff, contractors, or other attendees. By attending and participating in the Event, Participant agrees that PGH Craft Club may use, reproduce, and publish any photographs or video in which Participant appears, in whole or in part, for marketing, advertising, promotional, and social media purposes, in any format now known or later developed, without compensation to Participant.

If Participant would prefer not to be photographed or filmed, or not to have their image shared, Participant should notify event staff at the start of the Event so that PGH Craft Club can make reasonable efforts to accommodate that request (for example, by seating Participant outside the primary photo/video area or excluding identified images from selects used in marketing). PGH Craft Club will do its best to honor such requests but cannot guarantee that Participant will not appear, incidentally or otherwise, in photographs or video taken of the group, venue, or event space, and cannot guarantee removal of content already published or shared by third parties.

7. Minors

If Participant is under 18 years of age, this Agreement must be read, signed, and agreed to by Participant’s parent or legal guardian, who by completing this Agreement represents that they have the legal authority to do so and agrees to all terms of this Agreement, including the releases, assumption of risk, indemnification, and photography consent above, on behalf of both themselves and the minor.

8. Code of Conduct

PGH Craft Club is committed to a welcoming, respectful environment for all attendees, staff, and instructors. Harassment, discrimination, or abusive behavior of any kind will not be tolerated, including but not limited to conduct based on race, color, national origin, religion, sex, sexual orientation, gender identity or expression, age, disability, or any other characteristic protected by law, as well as verbal abuse, threats, intimidation, unwanted physical contact, or disruptive or unsafe behavior toward other attendees, staff, instructors, or venue personnel.

PGH Craft Club reserves the right, in its sole discretion, to remove any attendee from the Event for violating this Code of Conduct, and to refuse that attendee entry to future events, without refund of any ticket price, fees, or related costs.

Participant agrees to comply with all reasonable instructions from PGH Craft Club staff and instructors, as well as all venue rules and policies, and understands that failure to do so may result in removal from the Event under this section.

9. No Refund Policy

All ticket sales are final and non-refundable. Because PGH Craft Club events have limited capacity and require advance purchase of materials and supplies, staffing, and venue arrangements based on expected attendance, PGH Craft Club is unable to offer refunds, credits, or exchanges for any reason, including but not limited to Participant’s inability to attend, late arrival, early departure, dissatisfaction with the Event, or removal from the Event under the Code of Conduct section above.

If PGH Craft Club cancels an Event, Participant will be notified and offered a refund, credit toward a future event, or a rescheduled date at PGH Craft Club’s discretion. Any exceptions to this policy are solely at PGH Craft Club’s discretion and are not guaranteed.

10. General Provisions

Governing Law and Venue. This Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute arising out of this Agreement shall be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania.

Severability. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

Entire Agreement. This Agreement, together with any event-specific terms provided at registration, constitutes the entire agreement between Participant and PGH Craft Club regarding its subject matter and supersedes any prior oral or written understandings.

Electronic Acceptance. Participant’s electronic acceptance of this Agreement (including checking a box at checkout) has the same legal effect as a handwritten signature.

Acknowledgment

BY CHECKING “I AGREE” AT CHECKOUT, I CONFIRM THAT I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE, AND AGREE TO IT VOLUNTARILY AS MY OWN FREE ACT. I AM AT LEAST 18 YEARS OLD AND FULLY COMPETENT, OR I AM COMPLETING THIS CHECKOUT AS THE PARENT OR LEGAL GUARDIAN OF A PARTICIPANT UNDER 18 AND AGREE TO THIS AGREEMENT ON THEIR BEHALF.
